قبل استخدام منصة لقمة منيو، يُرجى قراءة الشروط والأحكام التالية بعناية. باستخدام المنصة، فإنك توافق على الالتزام بهذه الشروط والأحكام.

تشكل هذه الاتفاقية ("الاتفاقية") عقدًا قانونيًا بينك كمستخدم لمنصة لقمة منيو ("المستخدم")، ومنصة لقمة منيو. تشمل الاتفاقية جميع المرفقات والملحقات المشار إليها أو المرفقة معها.

1. التعريفات والتفسيرات

  • الحساب: الحساب الذي ينشئه ويستخدمه المستخدم للوصول إلى المنصة أو الخدمات.
  • المنصة: الموقع الإلكتروني أو تطبيق الهاتف المحمول أو أي واجهة إلكترونية تقدمها وتشغّلها شركة انتقاء للاستثمار والأنشطة المتعددة (INTIQAA FOR INVESTMENT & MULTI ACTIVITIES)، سجل تجاري رقم 1520944، سلطنة عُمان — صاحبة العلامة التجارية "لقمة منيو" (Loqma Menu).
  • الخدمة: الخدمات والوظائف التي تقدمها لقمة منيو عبر المنصة.
  • المستخدم: أي شخص يقوم بالوصول إلى المنصة أو استخدام خدمات لقمة منيو.
  • المعلومات: أي بيانات، تفاصيل، محتوى، صور، نصوص، مواصفات، ملفات، أو مواد أخرى يقدمها المستخدم أو توفرها المنصة.

2. تعريف المنتج – الخدمة المقدمة من منصة لقمة منيو

لقمة منيو هي منصة إلكترونية تتيح للمطاعم إنشاء وعرض قوائم الطعام الرقمية (المنيو الإلكتروني) عبر الإنترنت، مما يتيح للزبائن تصفح الأصناف بسهولة من خلال رابط أو رمز QR Code.

ما الذي يشمله الاشتراك في المنصة؟

  1. استخدام المنصة لإنشاء وعرض المنيو الإلكتروني.
  2. إدارة الأصناف والأسعار والتحديثات من خلال لوحة تحكم رقمية.
  3. إمكانية مشاركة المنيو الإلكتروني عبر رابط مباشر أو رمز QR قابل للطباعة.
  4. دعم فني أساسي لمشكلات الاستخدام الفني داخل المنصة.

ما الذي لا يشمله الاشتراك؟ الاشتراك في منصة لقمة منيو لا يشمل أي خدمات إضافية إلا إذا تم الاتفاق عليها بشكل منفصل، مثل:

  1. إعداد وإنشاء المنيو الإلكتروني في المطعم.
  2. القيام بترجمة المنيو.
  3. خدمات التصوير الاحترافي للأصناف.
  4. تصميم أو طباعة رموز QR.
  5. حاملات الباركود.
  6. إدارة المحتوى نيابة عن المطعم.
  7. أجهزة إلكترونية أو كهربائية مساندة لخدمات المنصة.

أي خدمات إضافية يتم تقديمها تكون برسوم منفصلة وفقًا للاتفاق بين الطرفين.

3. الأصناف المعروضة في المنيو

  • يجب أن تكون جميع الأصناف الغذائية المعروضة في المنيو عبر منصة لقمة منيو حلالًا ومتوافقة مع أحكام الشريعة الإسلامية للأطعمة والمشروبات. تحتفظ المنصة بحق حذف أي صنف يتم إضافته إذا كان لا يتوافق مع هذه المعايير.
  • في حال تكرار إضافة أصناف غير حلال، يحق لمنصة لقمة منيو إيقاف أو حذف المطعم بالكامل من المنصة دون الحاجة إلى إشعار مسبق، وذلك للحفاظ على التزام المنصة بتقديم خيارات غذائية متوافقة مع معايير المستخدمين.

4. إنشاء الحساب واستخدامه

  • لتقديم أو تحميل المحتوى عبر المنصة، يجب على المستخدم إنشاء حساب وفقًا لإجراءات التسجيل المحددة.
  • بعد إتمام عملية التسجيل بنجاح، يتم منح المستخدم حق الوصول إلى خدمات لقمة منيو عن طريق تسجيل الدخول إلى حسابه.
  • تحتفظ لقمة منيو بالحق في رفض منح الوصول لأي مستخدم وفق تقديرها المطلق.

5. الاشتراكات المدفوعة

  • يمكن للمستخدم الوصول إلى فترة تجريبية مجانية محدودة للخدمات عند إنشاء الحساب بحسب السياسة المعلنة في المنصة.
  • للاستمرار في استخدام الخدمات بعد انتهاء الفترة التجريبية، يجب على المستخدم الاشتراك في إحدى الباقات المدفوعة.
  • رسوم الاشتراك تُدفع مقدمًا على أساس دوري (شهري، ربع سنوي، سنوي) وفقًا للخطة التي يختارها المستخدم.
  • عند انتهاء فترة الاشتراك، يتم تجديد الاشتراك تلقائيًا ما لم يقم المستخدم بإلغائه قبل نهاية الفترة الحالية.
  • سياسة الإلغاء: يمكن للمستخدم إلغاء الاشتراك عن طريق لوحة التحكم الممنوحة له من قبل المنصة، أو عن طريق التواصل مع فريق المنصة.

6. دفع الرسوم

  • تحتفظ لقمة منيو بحق تعديل رسوم الاشتراك أو فرض رسوم إضافية على الخدمات، مع إخطار المستخدم قبل شهر واحد على الأقل من دخول التعديلات حيز التنفيذ.
  • جميع الأسعار لا تشمل ضريبة القيمة المضافة (VAT)، أو رسوم بوابات الدفع، ويتم إضافتها إذا كانت مطبقة وفقًا للقوانين المحلية.

7. شروط استخدام المعلومات

  • يقر المستخدم بأن جميع المعلومات التي يقدمها عبر المنصة صحيحة ودقيقة ومحدثة، وأنه يمتلك جميع الحقوق اللازمة لنشرها.
  • يمنح المستخدم منصة لقمة منيو حقًا غير حصري ودائم وخالٍ من الحقوق لاستخدام وإعادة إنتاج ونشر وتوزيع المعلومات التي يقدمها عبر المنصة، وذلك فقط فيما يتعلق بالبيانات الشائعة مثل قائمة الطعام، الأسعار، الصور، وصف المنتجات، والعروض الترويجية، وذلك لأغراض تشغيل الخدمة وتحسين تجربة المستخدم. أما فيما يتعلق بالمعلومات الخاصة أو الحساسة، مثل البيانات المالية أو بيانات العملاء، فإن المنصة تلتزم بعدم استخدامها أو مشاركتها مع أي طرف ثالث دون موافقة مسبقة من المستخدم، باستثناء الحالات التالية:
    1. طلبات الجهات الرسمية أو الامتثال للأنظمة والقوانين المعمول بها في الدولة.
    2. الاستخدام الداخلي لأغراض التحليل الإحصائي، تحسين الخدمات، أو تطوير استراتيجيات تسويقية، دون انتهاك خصوصيتها مع أطراف خارجية.
    3. الاستخدام في دراسات أو تحليلات متعلقة بقطاع الأغذية والصحة العامة، دون تحديد هوية المطاعم أو العملاء بشكل مباشر.
  • يُحظر على المستخدم نشر أي محتوى مخالف للشريعة الإسلامية والقوانين أو مسيء أو ينتهك حقوق الآخرين.

8. المسؤولية القانونية

  • يتم تقديم الخدمات والمنصة "كما هي" و"حسب توفرها" دون أي ضمانات صريحة أو ضمنية.
  • لقمة منيو لا تضمن دقة أو اكتمال المعلومات المقدمة على المنصة، سواء من قبل المستخدمين أو أي طرف ثالث.
  • لا تتحمل لقمة منيو أو موظفوها أو شركاؤها أي مسؤولية عن أي أضرار مباشرة أو غير مباشرة ناتجة عن استخدام المنصة أو الخدمات.

9. الشروط والأحكام العامة للمستخدمين النهائيين

  • "لقمة منيو" هو وسيط رقمي بين المطاعم وعملائها، ولا يتحمل أي مسؤولية عن جودة الطعام، دقة الأسعار، توفر المنتجات، أو مواعيد التوصيل.
  • يتم جمع بعض البيانات مثل تفضيلات الطلبات بهدف تحسين تجربة المستخدم، دون مشاركتها مع أي طرف ثالث لأغراض تجارية خارج نطاق الخدمة.
  • يمكنك طلب حذف بياناتك في أي وقت من خلال إعدادات الحساب أو التواصل مع الدعم.
  • تبذل المنصة أقصى جهدها لضمان تجربة سلسة، لكنها غير مسؤولة عن أي أعطال تقنية قد تؤثر على عرض القوائم أو إتمام الطلبات.
  • في حال واجهت مشكلة تقنية، يمكنك التواصل مع الدعم الفني للمنصة.
  • يمكن تحديث هذه الشروط من وقت لآخر، ويُعتبر استمرار استخدامك للمنصة بعد التحديث موافقةً على الشروط الجديدة.

10. التعديلات

تحتفظ منصة لقمة منيو بحق إجراء تعديلات أو تحسينات أو تحديثات على خصائص الخدمة المقدمة، سواء من حيث الميزات التقنية، واجهة المستخدم، أو أي وظائف أخرى، وذلك بما يتماشى مع التطورات التكنولوجية ومتطلبات العمل.

  1. التعديلات والتحديثات على الخصائص:

    • قد تقوم المنصة بإضافة ميزات جديدة أو تحسين الميزات الحالية لتعزيز تجربة المستخدم.
    • يحق للمنصة إزالة أو تعديل بعض الميزات أو الأدوات إذا لم تعد ملائمة أو تم استبدالها ببدائل أكثر كفاءة.

  2. الامتيازات والتغييرات في الخطط المدفوعة:

    • يحق للمنصة تحديث خطط الاشتراك، الأسعار، أو الامتيازات المتاحة وفقًا للمتغيرات السوقية أو التطويرية.
    • أي تعديلات على الأسعار أو الخدمات المدفوعة لن تسري على المستخدمين المشتركين حاليًا إلا بعد انتهاء فترة اشتراكهم المدفوعة.
    • سيتم إبلاغ المستخدمين مسبقًا بأي تغييرات في الأسعار أو الخطط قبل تجديد الاشتراك، ليتمكنوا من اتخاذ القرار المناسب بشأن استمرار الاشتراك أو تعديله.

  3. قبول التحديثات والتعديلات:

    • استمرار استخدام الخدمة بعد إجراء أي تعديلات على الخصائص يُعد موافقة ضمنية على التغييرات الجديدة.
    • إذا لم يوافق المستخدم على التعديلات، يحق له إنهاء الاشتراك أو التواصل مع دعم المنصة لمناقشة الخيارات المتاحة.

تحتفظ لقمة منيو بحق تعديل أو تحديث هذه الشروط والأحكام في أي وقت. يتم إخطار المستخدمين بالتعديلات من خلال نشرها على المنصة أو إرسالها عبر البريد الإلكتروني. استمرار استخدام المنصة بعد التعديلات يُعتبر قبولًا للشروط المحدثة.

11. القانون واجب التطبيق وحل النزاعات

  • تُخضع هذه الشروط والأحكام للقوانين المعمول بها في سلطنة عمان.
  • يتم حل أي نزاعات تنشأ عن هذه الشروط من خلال التفاوض الودي. وإذا تعذر حل النزاع، يتم اللجوء إلى المحاكم المختصة في سلطنة عمان.

Terms and Conditions for the Loqma Menu Platform

Before using the Loqma Menu platform, please read the following Terms and Conditions carefully. By using the platform, you agree to be bound by these Terms and Conditions.

This agreement ("Agreement") constitutes a legal contract between you as a user of the Loqma Menu platform ("User") and the Loqma Menu platform. The Agreement includes all attachments and appendices referenced or attached to it.

1. Definitions and Interpretations

  • Account: The account created and used by the User to access the Platform or Services.
  • Platform: The website, mobile application, or any electronic interface provided and operated by INTIQAA FOR INVESTMENT & MULTI ACTIVITIES, Commercial Registration No. 1520944, Sultanate of Oman — owner of the "Loqma Menu" brand.
  • Service: The services and functions provided by Loqma Menu through the Platform.
  • User: Any person who accesses the Platform or uses Loqma Menu's services.
  • Information: Any data, details, content, images, text, specifications, files, or other materials provided by the User or made available by the Platform.

2. Product Definition — Service Provided by the Loqma Menu Platform

Loqma Menu is an electronic platform that enables restaurants to create and display digital food menus online, allowing customers to browse items easily through a link or QR Code.

What does the platform subscription include?

  1. Use of the platform to create and display the digital menu.
  2. Management of items, prices, and updates through a digital control panel.
  3. The ability to share the digital menu via a direct link or a printable QR code.
  4. Basic technical support for technical usage issues within the platform.

What does the subscription not include? Subscribing to the Loqma Menu platform does not include any additional services unless separately agreed upon, such as:

  1. Setting up and creating the digital menu at the restaurant.
  2. Menu translation.
  3. Professional photography services for menu items.
  4. Design or printing of QR codes.
  5. Barcode/QR stands.
  6. Managing content on behalf of the restaurant.
  7. Electronic or electrical devices supporting the platform's services.

Any additional services provided are subject to a separate fee as agreed between the parties.

3. Menu Items

  • All food items displayed on the menu through the Loqma Menu platform must be halal and compliant with Islamic dietary provisions for food and beverages. The Platform reserves the right to remove any item added that does not comply with these standards.
  • If non-halal items are repeatedly added, Loqma Menu reserves the right to suspend or remove the restaurant entirely from the platform without prior notice, in order to maintain the platform's commitment to offering food options that comply with user standards.

4. Account Creation and Use

  • To submit or upload content through the platform, the User must create an account in accordance with the specified registration procedures.
  • Upon successful completion of registration, the User is granted access to Loqma Menu's services by logging into their account.
  • Loqma Menu reserves the right to refuse access to any user at its sole discretion.

5. Paid Subscriptions

  • Users may access a limited free trial period for the services upon account creation, in accordance with the policy published on the platform.
  • To continue using the services after the trial period ends, the User must subscribe to one of the paid plans.
  • Subscription fees are paid in advance on a periodic basis (monthly, quarterly, or annually) according to the plan chosen by the User.
  • Upon expiry of the subscription period, the subscription automatically renews unless the User cancels it before the end of the current period.
  • Cancellation Policy: The User may cancel the subscription through the control panel provided by the platform, or by contacting the platform's team.

6. Payment of Fees

  • Loqma Menu reserves the right to modify subscription fees or impose additional charges on services, with the User notified at least one month before such changes take effect.
  • All prices exclude Value Added Tax (VAT) or payment gateway fees, which will be added where applicable in accordance with local laws.

7. Terms of Information Use

  • The User acknowledges that all information provided through the platform is true, accurate, and up to date, and that they hold all rights necessary to publish it.
  • The User grants the Loqma Menu platform a non-exclusive, perpetual, royalty-free right to use, reproduce, publish, and distribute the information they provide through the platform, solely in relation to general data such as the food menu, prices, images, product descriptions, and promotional offers, for the purposes of operating the service and improving the user experience. With respect to private or sensitive information, such as financial data or customer data, the platform undertakes not to use or share it with any third party without the User's prior consent, except in the following cases:
    1. Requests from official authorities or compliance with applicable regulations and laws in the country.
    2. Internal use for statistical analysis, service improvement, or development of marketing strategies, without compromising privacy with external parties.
    3. Use in studies or analyses related to the food and public health sector, without directly identifying restaurants or customers.
  • The User is prohibited from publishing any content that violates Islamic law and applicable laws, is offensive, or infringes on the rights of others.

8. Legal Liability

  • The services and platform are provided "as is" and "as available," without any express or implied warranties.
  • Loqma Menu does not guarantee the accuracy or completeness of the information provided on the platform, whether by users or any third party.
  • Loqma Menu, its employees, and its partners shall not be liable for any direct or indirect damages resulting from the use of the platform or its services.

9. General Terms and Conditions for End Users

  • "Loqma Menu" is a digital intermediary between restaurants and their customers and bears no responsibility for food quality, price accuracy, product availability, or delivery times.
  • Certain data, such as order preferences, is collected to improve the user experience, without being shared with any third party for commercial purposes outside the scope of the service.
  • You may request deletion of your data at any time through account settings or by contacting support.
  • The platform makes every effort to ensure a smooth experience but is not responsible for any technical malfunctions that may affect the display of menus or the completion of orders.
  • If you encounter a technical issue, you may contact the platform's technical support.
  • These terms may be updated from time to time, and continued use of the platform after an update constitutes acceptance of the new terms.

10. Amendments

The Loqma Menu platform reserves the right to make amendments, improvements, or updates to the features of the service provided, whether in terms of technical features, user interface, or any other functions, in line with technological developments and business requirements.

  1. Amendments and Updates to Features:

    • The platform may add new features or improve existing ones to enhance the user experience.
    • The platform has the right to remove or modify certain features or tools if they are no longer suitable or have been replaced by more efficient alternatives.

  2. Privileges and Changes to Paid Plans:

    • The platform has the right to update subscription plans, prices, or available privileges according to market or developmental changes.
    • Any changes to the prices of paid services or features will not apply to currently subscribed users until their paid subscription period has ended.
    • Users will be notified in advance of any changes to prices or plans before subscription renewal, so they can make an appropriate decision regarding continuing or modifying their subscription.

  3. Acceptance of Updates and Amendments:

    • Continued use of the service after any amendments to its features constitutes implicit consent to the new changes.
    • If the User does not agree to the amendments, they have the right to terminate the subscription or contact platform support to discuss available options.

Loqma Menu reserves the right to amend or update these Terms and Conditions at any time. Users will be notified of amendments through publication on the platform or via email. Continued use of the platform after amendments constitutes acceptance of the updated terms.

11. Governing Law and Dispute Resolution

  • These Terms and Conditions are governed by the laws applicable in the Sultanate of Oman.
  • Any disputes arising from these terms shall be resolved through amicable negotiation. If the dispute cannot be resolved, it shall be referred to the competent courts in the Sultanate of Oman.
